Law No. (29) of 2019 Concerning the Establishment of Abu Dhabi Research and Development Authority

المادة 1 — In the implementation of the provisions of this Law, the following words and ¶

phrases shall have the meanings corresponding thereto unless the context
requires otherwise:
State: The United Arab Emirates
Emirate: The Emirate of Abu Dhabi
Goverment: Abu Dhabi Goverment
Executive Council: The Executive Council of the Emirate
Department: The Department of Education and Knowledge.
Authority: Abu Dhabi Research and Development Authority.

المادة 2 — يُنشأ جسم تنظيمي وفقاً لأحكام هذه القوانين ¶

تحت اسم "هيئة أبوظبي للبحث والتطوير". وتحظى الهيئة بشخصية اعتبارية مستقلة، وتتمتع بالقدرة القانونية الكاملة على التصرف، وتتبع وزارة.

المادة 3 — The main office of the Authority shall be located in Abu Dhabi City. Branches ¶

of the Authority may be established inside or outside the Emirate by a
resolution of the Chairman of the Department following the approval of the
Executive Council.

المادة 4 — • The Authority shall assume the following competencies: ¶

1. Propose general policies, strategic plans and initiatives related to the
research and development system and submit them to the Department
in preparation for approval by the Executive Council.
2. Determine the priorities of the research and development system in
the Emirate in all fields in consistence with the overall directions and
aspirations of the government.
3. Prepare the plans and programmes including the funding programmes
aimed at expanding the research and development capabilities in the
Emirate.
4. Lay down the controls and standards based on which the research
and development contracts are approved, funded and concluded for
individuals and institutions, and submit them to the Executive Council
for approval.
5. Manage and Implement the programmes of academic research and
development related to research funding of researches and academic
institutions at the Emirate level to serve the vision and aspirations of
the Emirate.

6. Launch, adopt and supervise the research and development initiatives
funded by the Government.
7. Cooperate and coordinate with all the parties concerned with research
and development for the enhancement of this field.
8. Study the funding grants applications of the academic institutions and
individuals in the research and development field and approve their
disbursement in accordance with the approved controls and standards.
9. Study the grants and funding applications submitted thereto by
the governmental entities regarding non-academic institutions and
corporations and express an opinion thereon.
10. Build and develop scientific and research partnerships with local and
international funding institutions and exchange experiences in order to
guarantee sustainable research and development growth.
11. Conclude agreements and memoranda of understanding with research
and scientific institutions inside and outside the State for the purposes
of cooperation in the research and development fields.
12. Provide advice and issue reports and studies in the research and
development fields.
13. Hold and participate in local, regional and international conferences,
seminars, meetings and workshops.
14. Implement strategies related to commercial activities and intellectual
property resulting from researches funded by the Authority.
• The Executive Council may amend the competencies of the Authority
occurring in this Law or any other legislation by deletion, addition or
transfer.
• The Authority may delegate some of its competencies to any other
governmental entity or outsource some of them to the private sector
following the approval of the Executive Council thereon.

المادة 5 — • يمكن للإدارة أن تضم رئيساً يُعين من قبل رئيس ¶

من قرارات مجلس الإدارة وتحت إشرافه على اختصاصات ومهام الجهة ورئيسها.

المادة 6 — • سُتُوصَلُ المُسْتَفْتَى بِالْمُسْتَفْتَى بِالْمُسْتَفْتَى بِالْمُسْتَفْتَى ¶

يُعهد إليه تنفيذ ورقابة أعمال الجهة، وله أن يفعل ما يلي:
1. يقترح خطط استراتيجية وتنفيذية للجهة ويُقدّمها للموافقة وفقاً للتشريعات ذات العلاقة.
2. يتابع تنفيذ خطط استراتيجية وتنفيذية للجهة بالإضافة إلى البرامج والمشاريع المُدارة أو المُنفذة أو المُرقابة من قبلها.
3. يُدير ويدّخر ويُنفذ جميع الوظائف الاستراتيجية والتنفيذية المُعهد بها للجهة مباشرة أو من خلال فرق العمل التي يُعيّنها أو يُوكلها إليها المهام، وفقاً للتشريعات ذات العلاقة.
4. يقترح المبادرات والبرامج والمشاريع والدراسات والتوصيات المتعلقة بمهام ونشاطات الجهة ويُقدّمها للموافقة وفقاً للإجراءات التي تتبعها الإدارة.
5. يقترح مسودة الميزانية السنوية للجهة ويُقدّمها للموافقة وفقاً للتشريعات ذات العلاقة.
6. يقترح هيكل تنظيمي للجهة ويُقدّمها للموافقة وفقاً للتشريعات ذات العلاقة.
7. يعيّن الخبراء والمستشارين والتقنيين مؤقتاً أو بشكل دائم ويحدد أجورهم. ويمكن له أن يستعين بأي خبراء أو مكاتب الاستشارات أو المؤسسات التي يرى أنها مناسبة.
8. يفتح حسابات بنكية باسم الجهة وفقاً للتشريعات ذات العلاقة.
9. يشكل لجان داخلية وفرق عمل من بين موظفي الجهة

9. تحديد مهام الموظفين وأشخاص آخرين وتحديد مهامهم وإجراءات العمل الخاصة بهم.
10. اقتراح القوانين والأنظمة التنظيمية والتنفيذية، والقواعد والسياسات والقرارات والرسائل المتعلقة بالاختصاصات التابعة للهيئة وتقديمها للتصديق وفقاً للقوانين التطبيقية.
11. اقتراح الرسوم والأسعار والأسعار المتعلقة بالاختصاصات التابعة للهيئة وتقديمها للتصديق وفقاً للقوانين التطبيقية.
12. تمثيل الهيئة أمام المحاكم والجهات الخارجية.
13. أي اختصاصات أو مهام أخرى تُعين عليها من قبل مجلس الإدارة.
• يمكن للمدير العام أن يفوض بعض اختصاصاته إلى أي موظف من موظفي الهيئة من الدرجة العليا، شرط أن يكون الفوضى مكتوبة.
• يمكن لمجلس الإدارة أن يفوض أي اختصاص من اختصاصات المدير العام إلى أي لجنة أو فريق عمل مُعين من بين موظفي الهيئة أو آخرين.

المادة 7 — • يمكن للإدارة أن تضم مجلساً استشارياً يتكون من على الأقل خمسة أعضاء ¶

أعضاء بما في ذلك رئيس مجلس الإدارة، ويجوز تعيينهم بقرار من مجلس الإدارة.
• ويجيب مجلس الإدارة تقديم المشورة والخدمات الاستشارية إلى الوزارة والهيئة فيما يتعلق بكل أو بعض اختصاصات الهيئة، وتقديم المقترحات والنصائح بشأن الخطط والبرامج والمشاريع والأنشطة التي تشرف عليها أو تُدار أو تُنفذ من قبلها.
• ويُعقد مجلس الإدارة اجتماعاته وفقًا للقواعد والأنظمة التي وافق عليها رئيس الوزارة.
• ويُمكن لرئيس الوزارة أن يفوض مجلس الإدارة لمتابعة أعمال المدير العام إذا لزم الأمر.

المادة 8 — تحتسب الجهة بالتقديم إلى الوزارة كل ستة أشهر أو في أي وقت ¶

تم طلب إعداد تقرير عن أعمالها وإنجازاتها وموازانتها وشؤونها الإدارية والمالية، والمراحل التي تم إنجازها من تنفيذ المهارات والمهام الموكَّلة إليها.

المادة 9 — يمكن للإدارة أن توفر الدعم اللوجستي بقرار من رئيسها ¶

وتحمّل جميع الأعمال التشغيلية المتعلقة بالخدمات الداعمة بما في ذلك الموارد البشرية والشؤون المالية، والمشتريات، ونظم المعلوماتية وغيرها من الأعمال والخدمات المتعلقة بالشؤون المؤسسية للهيئة.

المادة 10 — الموارد المالية للهيئة تتألف من ما يلي: ¶

1. المخصصات السنوية المخصصة لها من قبل الحكومة.
2. الهبات والمنح المقدمة لها بعد موافقة مجلس الوزراء.
3. الدعم المالي المقدم من قِبل القطاع الخاص والقطاع العام بالإضافة إلى مختلف الأفراد والمؤسسات التي تموّّل البحث العلمي، والمخصصة لتمويل أبحاث أو أنشطة معينة وتُوزَّع وفقًا لأغراض التوزيع المحددة لها، وذلك خارج الميزانية المعتمدة للإدارة.
4. أي دخل آخر وُافقت عليه من قبل مجلس الوزراء.

المادة 11 — يبدأ السنة المالية للإدارة في الأول من يناير ويُنتهي في ¶

أول يوم من ديسمبر من كل عام، باستثناء السنة المالية الأولى التي تبدأ من تاريخ دخول هذه القوانين حيز التنفيذ وتنتهي في آخر يوم من ديسمبر من السنة التالية.

المادة 12 — The Authority shall have one or more external certified auditors to verify its ¶

financial accounts and statements. They shall be appointed by a resolution
of the Depatment that also determines their remuneration, in accordance
with the legislations applicable in the Emirate.

المادة 13 — • The Authority shall be subject to the financial laws and regulations ¶

applicable in the Emirate except for the contracts related to scientific
research.
• The Human Recources rules and regulations applicable in the Emirate
shall apply to the Authority’s employees.
• The Nationals among them shall be subject to the civil retirement pensions
and benefits applicable in the Emirate.

المادة 15 — تبدأ هذه القوانين من تاريخ إصدارها وتُنشر في ¶

جريدة الرسمية.
