Law No. (6) of 2018 Concerning the Establishment of the Department of Transport

المادة 1 — In the implementation of the provisions of this Law, the following words and ¶

phrases shall have the meanings corresponding thereto unless the context
requires otherwise:
State : The United Arab Emirates.
Emirate : The Emirate of Abu Dhabi.
Executive
Council
: The Executive Council of the Emirate.
Department : The Department of Transport.
Transport
Sector
: The maritime sector, civil aviation sector and the
land transport sector in the Emirate, and their related
activities, infrastructure, systems and means of
transport.
Affiliates : The entities operating in the Transport Sector
affiliated to the Department and under its control and
supervision and are which are specified by a resolution
of the Executive Council.
Airports : Civil airports existing in the Emirate, and those that
may be established in the future.
Ports : Ports existing in the Emirate and any other ports that
may be established in the future except oil ports and
ports of the armed forces.

Maritime
Sector
: The sector concerned with all marine activities and
affairs in the Emirate's waters, ships, navigational aids,
ports, waterways, facilities, berths, infrastructure,
licenses, permits, approvals, commercial activities,
safety, security and their associated environment.
Civil Aviation
Sector
: The sector concerned with all matters related to
civil aviation and related aspects, including but not
limited to the air transport (commercial and private),
air navigation, air operations, airports, training and all
related activities.
Emirate’s
Waters
: Waterways, canals, bodies of water and waters
surrounding the Emirate's islands, as well as inland
waters and coastlines within the Emirate’s borders.
Waterways : The water areas surrounding the islands, whether
natural or artificial, as well as the coasts close to the
beaches in the Emirate.
Ship : Any facility which usually operates, or is intended to
operate in maritime navigation regardless of its power,
cargo or the purpose of its navigation, irrespective
of its type or shape, whether being with or without
an engine, designated for the carriage of persons or
goods or for any other commercial, non-commercial,
sport, or tourism purposes, or for fishing, cruising or
being used for trade, including the floating houses.

Maritime
Means of
transport
: Any boat, yacht, vessel, watercraft or any other mobile
and drivable maritime means of transport whatever its
purpose of use, which moves in the Emirate’s waters,
except for the internationally classified commercial
ships.
Land
Transport
Sector
: The sector concerned with all types of means of land
communication and transport, including traffic and
public transport, land and water means of transport,
means of transport of passengers, means of transport
of goods, the regulation of parking areas, weigh
stations, intelligent transport systems, activities,
infrastructure, facilities, services, logistics and assets,
and the related booking and distribution services,
including school transport, labours transport, tourism
transport, cycling and pedestrian routes, management
of congestion, mobility, safety, health and environment
related to the Sector.
Land
Transport
Means
: Any means intended for the transport of persons
and goods, whether being a vehicle, a bus, a truck, a
locomotive, a trailer, any mechanical vehicle, bicycle,
motorcycle, cart or any other device travelling on
roads by mechanical force or by any other means,
an amphibious vehicle or driverless vehicle, including
light and heavy vehicles, tractors, mechanical devices
of all types, as well as connected and autonomous
electric vehicles.

Public
Transport
: Transport for individuals and their luggage by different
means of transport that are classified as means of
public transport, either being land or water transport
into and out of the Emirate, including transport
by bus, train, metro, tram and taxi. It also includes
supporting infrastructure such as passenger and
vehicle terminals, waiting stations, control centres,
loading docks, as well as the railway workshops, lines
and tracks.

Transport
: Any means intended for the public transport of persons
and goods within the waters of the Emirate, including
but not limited to what is referred to as water bus or
water taxi.
Transport of
Goods
: It includes the transport of materials and live animals
by different means of transport designated for each
type of goods.
Roads : Lands allocated for road traffic, either paved or
unpaved, including all types of roads, inter alia roads
of maintenance and emergency, detours, bridges,
streets, tunnels, pathways and associated shoulders,
trenches, drains, sidewalks, pavements, safety
islands, roundabouts, squares, yards, sign boards,
lighting equipment, light signals, control devices and
their accessories, in addition to load-bearing walls
and their barriers.

Weigh
Stations
: Stations for monitoring the weights of freight vehicles.
Intelligent
Transport
Systems
: Electronic, electrical and mechanical systems and
equipments installed on roads and means of transport
connected, via a wired and wireless telecommunication
network, to central computers containing software
that are managed through dedicated control centres
that monitor and analyse the traffic data and make
the necessary changes automatically to ensure the
continuity of operation. Such systems cover control
of traffic, transport network, accident management,
ensuring traffic flow and raising safety standards for
the road network and means of transport. They also
include electronic payment and collection systems
for the fees charged for transport, parking areas, road
use, as well as connected and autonomous electric
vehicles.
Section (2)
Establishment, Objectives and Competencies of the Department

المادة 2 — • وفقاً لأحكام هذه القوانين، يُسمى القسم "القسم ¶

يُنشأ "الإدارة العامة للنقل" وتصبح وريثًا قانونيًا للإدارة العامة للشؤون البلدية والنقل فيما يتعلق بالأمور المتعلقة بقطاع النقل.
• جميع الأصول والملكية الخاصة بالإدارة العامة للتنمية العمرانية والبلديات، بالإضافة إلى الحقوق والالتزامات المتعلقة بها، تُنقل إلى الإدارة العامة للنقل، بعد موافقة رئيس الإدارة العامة للنقل ورئيس الإدارة العامة للتنمية العمرانية والبلديات.
• جميع الموظفين والعاملين في الإدارة العامة للتنمية العمرانية والبلديات، الذين تتضمن مهامهم أمورًا مرتبطة بقطاع النقل، يُنقلون إلى الإدارة العامة للنقل، بعد موافقة رئيس الإدارة العامة للنقل ورئيس الإدارة العامة للتنمية العمرانية والبلديات.

المادة 3 — The Department aims at achieving the following: ¶

• Achieving the highest level of economic growth, service, safety and security
standards, environmental protection and technological development in
the Transport Sector in the Emirate.
• Achieving the optimal level in the fields of ship services, cargo handling
and storage, and keeping pace with the developments in the field of
maritime transport, in accordance with the applicable legislations and in
cooperation with the competent authorities in the State.

المادة 4 — للتحقيق في أهدافها، يُفترض أن تقوم الإدارة بالاتصال التالي ¶

المهام:
1. اقتراح الخطط الاستراتيجية والتنفيذية للقطاع النقل في الإمارة، وتقديمها للratification من مجلس الإدارة، ورقابة تنفيذها.
2. متابعة تنفيذ التزامات الشركات التابعة بالخطط الاستراتيجية والتنفيذية.

القيام بخطط تنفيذية للقطاع النقل.
3. مراقبة ورقابة جميع الشركات التابعة لها، مثل إصدارها من ميزانياتها ودخلها، بالإضافة إلى التزاماتها بواجباتها ومسؤولياتها، واعتماد خططها الاستراتيجية وخطط التنفيذ.
4. تنظيم القطاع النقل في جميع الجوانب من خلال تطوير سياسات ومعايير وقوانين وقرارات وتعليمات تنفيذية وتشغيلية للقطاع المذكور.
5. مراقبة ورقابة القطاع النقل وفقاً للقوانين والاتفاقيات والمعاهدات السارية المتعلقة بالقطاع على المستوى المحلي والدولي، وبالتنسيق مع الجهات ذات العلاقة داخل الدولة وخارجها.
6. منح الترخيص للجهات والشركات والأشخاص العاملين في القطاع النقل ومراقبة تزامنهم في تقديم مستوى أقصى جودة للخدمات وفقاً للقوانين السارية، وبالتنسيق مع الجهات ذات العلاقة.
7. اقتراح الرسوم والأسعار والأسعار المرتبطة بمسؤولياته وتقديمها إلى مجلس الوزراء للحصول على الموافقة، وفقاً للأنظمة السارية.
8. تقديم تقارير دورية ودراسات تحليلية إلى مكتب إمارة أبوظبي المتعلقة بمسؤوليات الوزارة.
9. تشجيع الاستثمار والشراكات مع القطاع الخاص في المشاريع المتعلقة بمسؤوليات الوزارة وبالتنسيق مع الجهات ذات العلاقة.
10. أي مسؤوليات أو مهام أخرى تُعين عليها من قبل مجلس الوزراء.
• يمكن للوزارة أن تفوض بعض مسؤولياتها إلى أي جهة حكومية أخرى أو تفوضها للقطاع الخاص بعد موافقة مجلس الوزراء.

المادة 5 — • يصدر رئيس مجلس الوزراء قرارًا لتحديد ¶

أي مهام إضافية للإدارة.
• يمكن لمجلس الوزراء تعديل مهام الإدارة المذكورة في هذا القانون أو في أي تشريع آخر من خلال الحذف أو الإضافة أو النقل.

المادة 6 — كل الأشخاص والكيانات والشركات العامة والخاصة يلتزمون بـ ¶

الجهة المختصة بتقديم الوثائق والمعلومات التي تلزمها لتنفيذ أو تنفيذ مهامها.

المادة 7 — يصدر مجلس الإدارة قرارًا لتحديد الشركات التابعة التي ¶

سيتم مراقبة ورقابة هذه الأحكام من قِبل وزارة.

المادة 8 — بموافقة رئيس القسم، رئيس أبو ¶

يصدر قسم القضاء في دبي قراراً يحدد المسؤولين في القسم الذين تم منحهم صلاحية التحقيق في الجرائم ضمن اختصاصهم. ويكون لهم الحق في التفتيش والرقابة على جميع الجهات والشركات والأفراد الذين يعملون في قطاع التخطيط العمراني والبلديات، من أجل التحقق من تنفيذ أحكام هذه القوانين وتنظيماتها التنفيذية والقرارات والرسائل الإيضاحية.

المادة 9 — • يُحَرَّم إنشاء أي أعمال أو إنشاءات أو مشاريع أو إقامة ¶

يقوم بأي نشاط ضمن اختصاصات الإدارة دون الحصول على ترخيص من الإدارة وفقاً للأنظمة المطبقة.
• يجب على الشخص المرخص له بموجب الفقرة السابقة الالتزام بحدود الترخيص الممنوح له من الإدارة، واحترام القوانين والأنظمة والقرارات ذات العلاقة.
• لا يجوز استخدام أي وسيلة نقل لأداء أي من الأنشطة المنظمة من قبل الإدارة إلا إذا كانت مرخصة أو حصلت على الترخيص اللازم وفقاً للأنظمة المطبقة.

المادة 10 — • دون الإخلال بأي عقوبة أشد قد تُحدد بموجب أي قانون آخر ¶

القانون، يُفرض غرامة إدارية لا تتجاوز (10,000,000) درهم إماراتي، عشرة ملايين درهم إماراتي، على من يخالف أحكام هذا القانون وقواعد وقواعد التنفيذ والأنظمة والسياسات والقرارات والرسائل التنظيمية الخاصة به.
• يُتولى القسم مهمة جمع الغرامات الإدارية. وبعد موافقة مجلس الإدارة، يصدر رئيس القسم جدولًا يحدد الجرائم والغرامات الإدارية المقررة لكل منها، دون تجاوز الغرامة المقررة في هذا الماده.
• يجوز لرئيس القسم أو من يفوضه، تقديم التسوية مع المخالف، شرط أن تكون موثقة في محضر الجلسة. ويُدفع المخالف الذي قبل التسوية غرامة تعادل 75% من الغرامة الإدارية المقررة للجريمة خلال فترة لا تتجاوز ستين يومًا من تاريخ تقديم التسوية.
• وفي جميع الأحوال، إذا فشل المخالف في إزالة آثار الجريمة في التاريخ المحدد، يُقوم القسم بإزالة هذه الآثار على نفقته الخاصة.
• تحدد القواعد والأنظمة التنفيذية لهذا القانون إجراءات التسوية المذكورة أعلاه، بما في ذلك مهلاتها الزمنية.

المادة 11 — • يمكن للإدارة أن تفرض أي من العقوبات التالية: ¶

1. الإشعار.
2. التحذير.
3. وضع المؤسسة تحت الرقابة المالية والإدارية والتكنولوجية.
4. إيقاف النشاط مؤقتًا.
5. إلغاء أو إيقاف الترخيص.
6. إغلاق المؤسسة مؤقتًا أو دائمًا.
7. إزالة الأجانب الذين يرتكبون المخالفة الإدارية من المؤسسة بعد تنفيذ أي عقوبات إدارية أخرى قد تُفرض عليهم.
• يمكن رفع الشكاوى ضد العقوبات الإدارية أمام الإدارة خلال ستين يومًا من تاريخ إبلاغ المُشتكى عليه.

إذا لم يتم اتخاذ قرار بشأن الشكوى خلال تسعة وأربعين يومًا من تاريخ تقديمها، يُعتبر ذلك قبولًا للشكوى.
• تحدد اللوائح التنظيمية والتنفيذية لهذه القوانين الإجراءات والرقابة المطلوبة لتطبيق العقوبات الإدارية المذكورة أعلاه.

المادة 12 — الإدارة يمكنها التنسيق وتأسيس روابط إلكترونية مع ¶

الجهات ذات العلاقة. ويمكن أن تتخذ جميع التدابير اللازمة بالتنسيق مع هذه الجهات إذا لزم الأمر، لremoval أي وسائل نقل مرتبطة بقطاع النقل، وسحبها وحجزها مؤقتًا عند الحاجة وفقًا للقانون، حتى يتم إصدار حكم قضائي بحجز هذه الوسائل النقل وبيعها بالمزاد العلني بعد ستة أشهر من تاريخ حجزها، بينما يلتزم المخالف بدفع الرسوم والغرامات ويصلح العيوب الناتجة عنها وفقًا للإجراءات المنصوص عليها في التشريعات ذات العلاقة.

المادة 13 — تحتسب الإدارة بأوصافها التنظيمية وتقديمها ¶

للratification من قبل مجلس الإدارة وفقاً للأنظمة السارية.

المادة 14 — • The financial laws and regulations in force in the Emirate shall apply to the ¶

Department.
• The human resources laws and regulations in force in the Emirate shall
apply to the employees of the Department.
• The Civil Retirement Pensions and Benefits law in force in the Emirate
shall apply to the nationals.

المادة 15 — • بموجب موافقة مجلس الإدارة، Chairman of the ¶

يصدر الجهة القواعد التنظيمية والتنفيذية لهذا القانون.
• تبقى السياسات والأنظمة والقواعد والقرارات والرسائل الصادرة سارية المفعول بطريقة تتوافق مع أحكام هذا القانون حتى يتم إصدار القواعد التنفيذية والسياسات التشغيلية لهذا القانون.
• يصدر رئيس الجهة القواعد التنفيذية والتشغيلية لهذا القانون.

المادة 16 — • أي نص أو نصوص مُنظمة في القوانين التي تُنشئ الشركات التابعة ¶

التي تتعارض مع نصوص هذا القانون، يجب إلغاؤها.
• أي نص أو نصوص تتعارض مع نصوص هذا القانون يجب إلغاؤها.

المادة 17 — تُعتبر هذه القوانين سارية المفعول من تاريخ صدورها وتُنشر ¶
