1. DEFINITIONS
Berth: Wet Berth And/ or Dry Berth.
Claims: All claims, damages, losses, liabilities, demands, obligations, costs and expenses and
causes of action of any kind.
Cruise Co.: Cruise Ship Terminals Company – LLC -OPC “the Operator”
PMF: Public Marine Facilities Entity under Cruise Co. – Ports Cluster
DMT: Department of Municipalities & Transport
AED: The official currency of the United Arab Emirates (Emirati Dirham).
LOA: The size of the boat as Length Overall.
UOM: Unit of Measurement.
m: Measurement of length as meter.
ft.: Measurement of length as foot.
Hrs.: Measurement of time as hours.
FOC: Free of Charge.
VAT: Value Added Tax.
Users: Any individual or legal entity, including vessel and its owners, operators, shipping agents,
or any other person who accesses or uses the Marina, any berth or service. Users are
deemed jointly and severally liable for payment of all applicable tariffs, dues, and fees
incurred in relation to their activities.
Utilities: Supplied power & water to the boat during berthing alongside the berth.
Private: Berth rental for boats that are owned and registered by individuals for personal use such
as leisure or fishing.
Commercial: Berth rental for boats that are owned and registered by companies for business purposes.
Day: each of the twenty-four-hour periods, reckoned from one midnight to the next.
Month: each of the twelve named periods into which a year is divided.
Contract Year: consecutive 12-months period starting on a specified date, often the effective date of a
contract, and repeating annually throughout the contract's duration.
Wet Berth: A wet berth, also known as a wet slip or wet dock, is a designated spot in the water where
a boat is moored.
Dry Berth: A dry berth (either open or covered), or dry stack storage, involves lifting the boat out of
the water and storing it on land.
Marina: A set of buoys, docks, pillars, or similar structures designed to provide anchorage for a
Vessel primarily used for pleasure or leisure and includes additional features such as a
marine craft home, facilities for the repair and maintenance of marine craft and stations
for the provision of fuel, supplies, and other accessories.
Abu Dhabi: means the capital city of the United Arab Emirates (UAE), including its territorial
jurisdiction, as recognized under the laws of the UAE.
Al Dhafra Region: One of three Municipal Regions in the Emirate of Abu Dhabi. Forming the western part of
the United Arab Emirates).
Tariff Rates: Charges of AD Ports Cruise Business related to the rental of retail space and wet/dry (open
and covered) as well as supplied services within the public Marine Facilities in Abu Dhabi
and Al Dhafra Region.

2. TERMS AND CONDITIONS OF TARIFF FOR MARINA FACILITIES
2.1 General Terms
2.1.1 These terms and conditions apply to all users of the marina facilities.
2.1.2 The Operator reserves the right to revise tariffs and terms at any time with due notice.
2.1.3 All users must comply with local regulations, safety protocols, and environmental guidelines.
2.1.4 Terms & Conditions of Attested Marina Berth Leasing Contract from DMT are applied.
2.2 Tariff and Payment
2.2.1 All rates quoted are in AED and exclusive of 5% VAT.
2.2.2 All rates quoted are based on the Unit of Measurement (UOM).
2.2.3 Rates quoted per foot are calculated based on berth capacity or boat LOA, whichever is higher.
2.2.4 Only the annual berth leasing contract is inclusive of the free services listed in Section 7.
2.2.5 Day pass can be arranged upon request and based on availability at each marina.
2.2.6 Day pass rates in Section 5 are based on per day or part thereof scheduled in Section 5.
2.2.7 Payment is due in advance for the duration agreed upon in the contract.
2.2.8 AED 5.00 applied on each tariff item to be collected by the Operator.
2.2.9 A service fee of 0.76% of the total invoice value plus AED 1 will be applicable on the total invoice value,
excluding 5% VAT.
2.2.10 AED 100 applied for contract attestation fees as per the administrative Decision no. (69) of 2025
concerning "The Regulatory Bylaw for Maritime Safety in the Waterways of the Emirate of Abu
Dhabi
2.3 Services
2.3.1 All services are subject to availability at each marina and should follow the approved procedure.
2.3.2 Services will be provided on terms first come, first serve.
2.3.3 In case of service(s) request cancellation at any time for any reason(s), the service charge is applied
as per Section 6.
2.4 Utilities
2.4.1 In case a meter connection is available, utilities charges are based on actual consumption.
2.4.2 Flat rates for utilities scheduled in Section 7 are applicable to all berths, which include water and power
consumption, wherever there is no allocated utility meter on the berth’s pedestal.
2.4.3 Tariff Code 6.1 “Power supply to all vessels with LOA up to 10m” is optional upon request.
2.4.4 Utilities charges are applicable on monthly and annual rental contracts only.
2.4.5 Tariff Code 6.5 “Water supply to all vessel types” is applicable on all berth rentals.
2.5 Berthing & Mooring
2.5.1 Berthing and mooring allocations are subject to availability and marina management discretion.
2.5.2 Vessels must be properly secured and comply with marina safety requirements.
2.5.3 Subletting or transferring berths is strictly prohibited without prior approval.
2.5.4 The Operator is not responsible for (i) damage to vessels due to natural disasters or owner negligence
(ii) blockade or closure of the Marina or a Berth, (iii) shortage of berth space, labour, or insufficient
depth of water at any Berth or the approaches thereto, and (iv) strikes, lock-out or other industrial
action affecting the Marina, Berth and/or any services.
2.6 User Responsibilities
2.6.1 Users must maintain valid insurance covering their vessel, third-party liability and any environmental
risks.
2.6.2 Vessels must be seaworthy and comply with environmental and safety standards.
2.6.3 Users must ensure their vessels do not cause obstruction, pollution, or damage to other vessels or
marina facility.
2.6.4 User shall maintain (i) appropriately qualified and experienced officers and crew onboard the vessel in
order to maintain an alert watch and respond to emergencies and to enable Cruise Co. to provide the
services, and (ii) engines in a state of readiness to respond to emergency situations and to avoid delays
in vacating the Berth.
2.6.5 Users shall obtain and maintain, at its own expense, all necessary licenses, permits, and authorizations,
and comply with all applicable laws, conventions, regulations, rules, and codes of practice issued by
competent authorities.
2.7 Liability & Indemnity
2.7.1 The Operator is not liable for any theft, loss, or damage to vessel, its equipment, personal injury or
death or personal belongings regardless of cause.
2.7.2 User agrees to be responsible for and shall indemnify and hold harmless Cruise Co. against any Claims
arising from their use of the Marina and Berth including but not limited to loss of or damage to any
property, pollution, personal injury and death.

2.7.3 The Operator reserves the right to move or remove any vessel in case of emergency or non-compliance.
2.7.4 The User agrees to be responsible for, and shall indemnify and hold Cruise Co. harmless from, all and
any duties, taxes, imposts, levies, deposits and outlays of whatsoever nature levied by any competent
authority and/or any expenses incurred in complying with the requirements of any authority in
relation to the vessel.
2.7.5 The User shall be responsible for the security and safety of the vessel while berthed.
2.7.6 The User agrees, for and on behalf of itself, and the vessel and its owner and operator, to waive any
statutory right to limit liability for personal injury or property damage by establishing a limitation fund
under any applicable international convention or applicable law governing the liability of owners and/or
operators of seagoing vessels. The User hereby warrants that it has the authority to bind the vessel, its
owner and operator to such waiver of limitation.
2.7.7 The User agrees, for and on behalf of itself, and the vessel, its owner and operator, that in the event of
any damage or loss to the Marina, berth or any property, the User and the vessel owner will provide
security, in a form acceptable to Cruise Co. for worst case damages or losses, as determined by Cruise
Co.. In the event that such security is not provided, Cruise Co. shall, without prejudice to any other
remedies available to it, have the right to arrest or detain the vessel at the Marina, Berth or elsewhere
until such time as the security has been provided by the User or vessel owner.
2.8 Environmental Protection
2.8.1 Discharge of oil, fuel, sewage, or waste into the water is strictly prohibited.
2.8.2 Waste disposal must be carried out in designated areas following marina regulations.
2.8.3 Any environmental violations may result in penalties, including fines or expulsion from the marina.
2.9 Safety & Security
2.9.1 Users must adhere to marina security protocols and report any suspicious activity.
2.9.2 Children must be always supervised, and pets must be kept on a leash.
2.9.3 Fire and safety regulations must be followed.
2.10 Law and Jurisdiction
2.10.1 These terms and conditions shall be governed by and construed in accordance with the laws of the
Emirate of Abu Dhabi and the federal laws of United Arab Emirates as applicable therein.
2.10.2 The parties agree to submit to the exclusive jurisdiction of the competent courts of the Emirate of
Abu Dhabi for any dispute under these terms and conditions.
