Cabinet Resolution No. (36) of 2012 Regarding Advance Passenger Information Fee
The Cabinet:
− Having reviewed the Constitution,
− Federal Law No. (1) of 1972 Regarding the Competences of Ministries and Powers of Ministers, as amended,
− Federal Law No. (4) of 1996 Regarding the Establishment of the General Civil Aviation Authority, as amended,
− Federal Law No. (1) of 2011 Regarding the State Public Revenues,
− Cabinet Resolution No. (11/230 M/7) of 2012 Regarding the Draft Regulatory Resolution on the Advance Passenger Information Fee for Incoming Passengers to the State through Airports, and
− Upon the proposal of the Minister of Finance, and with the approval of the Cabinet,
Hereby resolves as follows:
Article (1)
1. A fee of (AED 5) five dirhams, to be known as the "Advance Passenger Information Fee", shall be imposed on each arriving, transiting, or departing passenger through the State's airports.
2. The following categories shall be exempted from the fee specified in Clause (1) of this Article:
a. Children not exceeding two years of age.
b. Aircraft crew members.
Article (2)
1. The fee referred to in Article (1) of this Resolution shall be collected upon the issuance of the travel ticket, irrespective of the place of its purchase or issuance.
2. The Ministry of Finance shall notify all airports in the State of the date of implementation of the provisions of this Resolution. In such case, the airports of the State shall notify all airlines, travel agencies, and other relevant entities of the implementation of the provisions of this Resolution.
Article (3)
The Ministry of Finance shall collect the fee directly or through other parties, in accordance with the mechanism determined by the Minister of Finance. The revenues from the fee shall be transferred to the Public Treasury of the State.
Article (4)
The Ministry of Finance shall appoint financial controllers, from within or outside the Ministry, to verify the collection of the fee stipulated in Article (1) of this Resolution.
Article (5)
All government entities concerned with civil aviation in the State shall cooperate with the Ministry of Finance in the implementation of this Resolution, each within its respective competence. Any provision that contradicts or conflicts with the provisions of this Resolution shall be repealed.
Article (6)
This Resolution shall be published in the Official Gazette and shall enter into force three months after the date of its publication.
