Cabinet Resolution No. (7) of 2017 Establishing the Office of the Minister of State for Tolerance
The Cabinet:
– Having reviewed the Constitution;
– Federal Law No. 1 of 1972 concerning the Competences of the Ministries and the Powers of the Ministers, as amended,
– Federal Decree-Law No. 11 for 2008 concerning Federal Government Human Resources, as amended,
– Federal Decree-Law No. 8 of 2011 on the Rules for Preparation of the General Budget and Final Accounts,
– Federal Law No. 8 of 2011 on the Reorganisation of the State Audit Institution,
– Federal Decree No. 28 of 2016 concerning the Formation of the Cabinet of the United Arab Emirates,
– Upon the approval of the Cabinet,
Hereby resolves:
Article (1) Definitions
In applying the provisions of this Resolution, the following words shall have the meanings assigned thereto, unless the context indicates otherwise:
State: United Arab Emirates.
Minister: Minister of State for Tolerance.
Office: Office of the Minister of State for Tolerance.
Article (2)
Under the provisions of this Resolution, an Office called the "Office of the Minister of State for Tolerance" shall be established, and it shall be supervised by the Minister.
Article (3) Office Powers
The Office shall undertake the following powers:
1. Follow up on the application of the provisions of Federal Law by Decree No. 2 of 2015 concerning Combating Discrimination and Hatred.
2. Establish a plan for the national programme to promote the values of tolerance, coexistence and peace; to eliminate extremism, hatred and discrimination in coordination with the relevant authorities; and to follow up on their implementation and development.
3. Raise awareness of the reality of the State as an ideal environment which embraces different nationalities and religions through the use of various means of communication and information that are available locally, regionally and internationally.
4. Organise events and activities locally, regionally, and internationally that promote tolerance, coexistence, peace, shared human values, cultural pluralism, and acceptance of others in terms of thinking, culture, religion and ethnicity.
5. Provide help and administrative support to the Minister in the tasks assigned to her; and
6. Represent the State in regional and international forums that call for the values of tolerance and respect for others, dialogue of civilizations, religions and cultures, and eliminating intolerance, hatred, extremism and discrimination.
7. Any other powers assigned to the Minister in accordance with the laws, regulations, and Cabinet resolutions issued in this regard.
Article (4) The Minister
a. The Minister shall be responsible for drawing up the general policy of the Office and managing its affairs, and shall exercise the following powers in particular:
1. Implement the policy and strategic plans of the Office.
2. Supervise the work flow of the Office in general, adopt decisions regulating this and follow-up on the completion reports.
3. Supervise the preparation of drafts for the Office budget and the final account, and follow up on the budget implementation within the financial allocations approved therefor.
4. Propose the organisational structure of the Office and submit it to the Cabinet for approval.
5. Issue the laws and regulations for the organisation of the Office work flow.
6. Supervise the Office assignments in general as ordered by the Prime Minister with regard to tolerance.
b. Any other powers assigned to her by law or a Cabinet resolution or by the Prime Minister.
The Minister may authorise certain powers to whom she deems fit among the Office staff.
Article (5) Office Budget
The Ministry of Finance shall allocate the necessary financial amounts to the annual budget of the Office. Spending from this budget and its supervision shall be in accordance with the financial regulations in force in the independent federal authorities.
Article (6) Auditing
The Office shall be subject to the control of the Audit Bureau, and it shall provide the Bureau with all the data or information it requires related to its business.
Article (7) Human Resources, Laws and Financial Regulations
1. Office staff shall be subject to Federal Decree-Law No. 11 of 2008 concerning Human Resources in the Federal Government, or any other legislation that replaces it.
2. The provisions of the applicable laws and regulations of the independent federal authorities shall apply to the Office.
Article (8) Publication and Entry Into Force
This Resolution shall come into force as of the date it is issued and shall be published in the Official Gazette.
