1. Definition and Conditions
The following schedule of charges, definitions and conditions shall apply in addition to the Abu
Dhabi Ports Standard Terms and Conditions, which shall form an integral part of the schedule
of charges and govern the use of the port or provision of services by Abu Dhabi Ports.
"VAT" means any Value Added Taxes or similar excise taxes, sales added or use taxes (as
defined in any relevant legislation in the relevant territory, as amended or re-enacted from
time to time, and legislation supplemental to it) imposed or to be imposed upon any payment
due to AD Ports pursuant to this Tariff, at the rate in force when the relevant supply is made
and includes any tax or taxes of a similar nature substituted for, or levied in addition to, such
tax or taxes.
i. All amounts in this tariff are VAT exclusive. All other services defined under Port
General Charges are eligible for standard VAT rate according to the applicable Laws
and regulations.
ii. Any Services related to the international transportation of goods or Passenger shall be
subject for Zero rated VAT as per the Federal Decree-Law No. (8) Of 2017 on Value
Added Tax
iii. International transportation means (transporting passengers or Goods, either or both,
if the first place of departure, or the final place of destination, is outside UAE) according
to the Federal Decree-Law No. (8) Of 2017 on Value Added Tax
Terms Meaning
ADP The Abu Dhabi Ports Company
Authority This refers to the relevant agencies and authorities with
jurisdiction over the Port, Customs, Immigration, Municipality,
and related activities in the Emirate of Abu Dhabi, UAE, as well as
any Federal Authorities within the UAE.
Cargo All types of cargo, whether containerized or non-containerized,
including but not limited to solid, liquid, live animals, vehicles,
loose cargo, project cargo, dry bulk, general cargo, full container
loads (FCL), less than container load (LCL), empty containers,
and any other items transported or to be transported by a vessel.
Cargo Handling
Charges
This refers to the charges imposed for services including (i)
Stevedoring, (ii) Restows, (iii) Shifting, (iv) Storage,
(v) Reefer monitoring, (vi) or any other services as determined by
the Dry Port Operator from time to time.
Carrier Any party or parties involved with the vessel, including but not
limited to its agents, owners, operators, and/or charterers.
CFS Container Freight Station.
Conditions This schedule of charges is applicable to all AD Ports unless a
specific port is mentioned.
Consignee A person or entity, which may also be the buyer of the cargo,
holds the financial responsibility for receiving the cargo.

Container This refers to any standard ISO container designed for stacking
and transporting cargo, including dry, liquid, gas, or reefer cargo.
These containers are constructed from metal, fiberglass, plastic,
or wood and must be capable of being handled as a unit and lifted
by a crane with a container spreader.
Container Yard This refers to within the boundaries of the respective Dry Port.
Day A calendar day comprising 24 consecutive hours starting at
midnight.
DG Dangerous Goods (Containers carrying IMDG Cargo)
Dry Port The Dry Port Operator’s multi-user, land and premises used by
the Dry Port Operator at the Port.

Operator or any of its contractors.
Handling
Charges
The charges levied for the utilization and transit, through the
Port’s yard and gate infrastructure.
NOC No Objection Certificate.
Port Authority Abu Dhabi Ports Authority.
Port Clearance
Certificate
A certificate issued by AD Ports to vessels that have fulfilled all
government formalities, have not been detained by a court order
or government agency, and have settled all charges owed to AD
Ports, before being granted permission to depart from an AD
Ports Port.
Ports Seaports at Abu Dhabi.
Reefer Cargo Refrigerated cargo.
Tariff The prices charged by the Dry Port Operator in respect of the Dry
Port Services, or for any additional services, as may be agreed
between the Dry Port Operator and the Carrier from time to time.
TEU Twenty-foot equivalent unit.
THC Dry Port Handling Charges levied for the services of Stevedoring;
Re-stows; and shifting; or charges incurred for any other services
as may be determined by AD ports from time to time for either
containerized cargo or non-containerized cargo, or both, when
handled to/from same vessel.
Transshipment This refers to containerized, or non-containerized cargo
discharged in the Dry Port from a Vessel/Truck for the purpose of
reshipment to another port without leaving the Dry Port until the
time of reshipment.

2. Notes
Alterations to the schedule of charges:
ADPORTS reserves the right to amend, change, edit or alter from time to time, any or all
items under this schedule of charges, including terms and conditions or interpretations
contained herein.
Currency:
All charges and rates mentioned in this schedule of charges are payable in United Arab
Emirates Dirhams.
Documentation:
The documentation required for the processing of any application or interaction with ADPORTS
is available on the ADPORTS website.
Notice of Arrival (NOA):
Procedures and documentation are available on the ADPORTS website. (www.adports.ae)
Administration - Working Hours:
ADPORTS administration working hours are from 07:30 hours to 15:30 hours Monday to
Friday, excluding public holidays. ADPORTS offices are closed on Saturdays and Sundays.
Consent to these Terms and Conditions:
The use of any channel(s), port(s) and/or Dry Port(s) or facility managed and/or monitored
by ADPORTS shall automatically constitute agreement to the terms and conditions of this
Schedule of charges between ADPORTS and all port users including, but not limited to vessels,
their owners, crew, agents and/or representatives, operators, charterers, mortgagors,
mortgagees, cargo agents, stevedores, cargo owners, forwarders, shippers and consignees,
to be governed by all the rules and regulations, terms and conditions, abide by them and pay
all rates and charges specified herein.
Administration:
The Administration & Control of all Abu Dhabi Non-Oil and Non-Military ports are under the
management of Abu Dhabi Ports Company PJSC (ADPORTS). The facilities and services
provided by ADPORTS are covered and governed by this schedule of charges.
Jurisdiction:
ADPORTS has jurisdiction by Emiri Decree No. 6 of 2006 to own, operate, maintain, manage
and develop all port-related facilities in Abu Dhabi (excluding Oil & Gas and military).
Application and Administration of this Schedule of charges:
All Rates, Rules and Regulations contained in this schedule of charges and/or changes thereto
shall apply unless otherwise specifically approved in writing by ADPORTS.

Payment Deposit:
All charges are payable by registered agents with ADPORTS. For registration procedures refer
to www.adports.ae.
Vessels may be denied permission to berth, sail or move if found in non-compliance.

4. Terms and Conditions
a) All charges are stated in UAE Dirhams and exclusive of VAT or any other
governmental charges which may be applicable from time to time as directed by the
UAE “Authority”.
b) Unless otherwise specified herein, the charges mentioned are applicable per
Container of specified.
c) Any other charges not listed herein are subject to the specific scope of works, services
required and cargo type.
d) Charges for the handling of non-containerized Cargo, hire of equipment, cleaning
and/or repairing of Containers, provision of equipment interchange reports or any
other services which are not mentioned in this Tariff shall be provided on request and
for a specific scope of services.
e) Appointment and other ATLP charges will be as applicable.
f) All taxes as applicable will be additional.
g) All equipment for hire will be subject to availability.

5. Dangerous Cargo
a) All Containers with Dangerous Cargo, irrespective of class, will be levied an
additional charge over and above of the applicable Rates.
b) The cost of repairs to the Dry Port premises, property or equipment or other
containers and its cargo resulting from spilled Dangerous Cargo and
subsequent clean-up operations will be on the Carrier’s account. In the event
of an emergency requiring the standby of fire/security/medical personnel,
additional charges will apply.
c) Containers with undeclared, poorly stowed or incorrectly packaged Dangerous
Cargo may receive fines at the discretion of the Authority and/or the Dry Port
Operator.
d) Containers with missing placards, wrong placards, incomplete placards and
any International Maritime Dangerous Goods Code violation will receive fines
at the discretion of the Authority, or such other charges as determined by the
Authority.
e) There will be no free storage period for Dangerous Cargo and any Containers
holding Dangerous Cargo.

6. Storage Period Conditions
a. Import
i. Storage period will commence from the date the container enters the DRY
PORT. A day or part thereof will be considered as one calendar day.
ii. All Containers with Dangerous Goods irrespective of the class will be levied
an additional 50% of the applicable storage charges. No free storage period
for Dangerous Cargo and any Containers holding Dangerous Cargo. In case
of a container falling under both OOG & IMCO categories, 50% will be added
to the charges applicable to OOG.
iii. Storage at the rate of the maximum applicable rate (Tier iii) will be applied
for any unlisted Containers discharged until the details are received. Free
storage will be applicable only from the date the Dry Port Operator receives
the accurate and complete information in writing.
b. Export
i. Storage period will commence from the date the container received for
export at the Dry Port and applicable until the date the container exits Dry
Port for onward movement to Khalifa Port.
ii. In case of Containers moved under customs bond, the free period shall be
calculated from the date the container received for export at the first point.
iii. All Containers with Dangerous Goods irrespective of class will be levied an
additional 50% of the applicable storage charges. No free storage period
for Dangerous Cargo.
c. Empty Received
i. Storage period will commence from the date the empty container received
at the Dry Port and applicable until the date the container exits Dry Port.
ii. In case of Containers moved from one facility of AD ports to another facility
of AD Ports the storage period shall be calculated from the date the empty
container is received by AD Ports at the first point of entry.
iii. Empty Containers with IMCO residues shall be treated as IMCO containers
and will be levied an additional 50% of the applicable storage charges. No
free storage period shall be extended for those empty containers.

7. Reefer Monitoring

b. Reefer Container Monitoring Conditions:
a) The charges shall be applicable per day or part thereof commencing from the
date of plug in at Dry Port. In case of Exports, the charges shall be payable
by Exporter/Line/ Agent and shall commence from the date the container
received for export at the Dry Port and applicable until the date container
exits the dry port.
b) These charges are in addition to the appropriate Container rates and storage
charges. Repairs to malfunctioning reefers will be carried out on request at
additional cost and as per services required.
c) The reefer monitoring services include:
i. Plug-in and Plug-out of full reefer containers to the energy supply
connections provided by the Dry Port.
ii. Supply of energy
iii. Reefer Container temperature monitoring and which also includes
temperature check reports.
d) The reefer monitoring services exclude:
i. Datalogger downloads and reporting.
ii. Container repair either machinery of structure or both.
iii. Set point changes or adjustments.

Special Conditions:
a) It is mandatory that all flat racks delivered to the Dry Port should be in a
knocked- down position. The Dry Port Operator will knock down any flat rack not
delivered in knocked down position and the service will be charged accordingly
to the Carrier/agent or the Consignee.
b) Whenever additional shifting is required in any of the above operations,
appropriate shifting charges will be applied in addition to the above charges.
c) Rates for other requirements, services or facilities to be discussed and agreed on
a case-by-case basis.

• Cleaning charges may be adjusted according to the extent and the respective
size of the leak. In the case of leakage of Dangerous Cargo, a suitably equipped
and qualified contractor will be arranged at the party’s expense concerned and
at the Dry Port Operator’s discretion and urgency.

10. Undelivered Containers – Auction
a) If non-perishable Cargo remains in the Dry Port unclaimed for a period of more
than ninety (90) days and perishable Cargo remain in the Dry Port unclaimed for
a period of more than sixty (60) days, the Dry Port Operator reserves the right,
without any notice, to remove the Cargo to a bonded storage area. However, this
will not release the Carrier from their obligation to pay the outstanding payment
to the Dry Port Operator. The Carrier shall indemnify the Dry Port Operator from
all losses, damages and claims which may arise after or as a result of such disposal.
b) Containers containing Cargo destined for Disposal shall only be released after all
stripping and stuffing charges and storage charges have been received by the
Dry Port Operator. These charges will be on the Carrier’s account.
c) Method of Payment
a. All invoices are raised as due on presentation, unless otherwise either agreed
in writing or under specific service agreement contracts. The Dry Port Operator
reserves the right to apply interest at the rate of 2% per month on any invoice
or part thereof remaining unpaid beyond the due date.
b. In the event of failure to pay within the time set out above and without
prejudice to the rights available under the Dry Port Operator shall have a lien
over all Containers and Cargo and all documents in respect of payments due.
If the payment is not made in full within one month of the lien being exercised,
the Dry Port Operator shall have the right of sale over all the property, either
by direct sale or public auction and may set off the proceeds of sale in
satisfaction of the charges due to the Dry Port Operator.
c. The respective Carrier or the responsible party will indemnify the Dry Port
Operator and will pay to the Dry Port Operator full charges, compensation for
all damages suffered by the Dry Port Operator, in the event the Consignee is
in breach of its obligation to pay any charges stated herein
d. The Rates / Tariff mentioned herein are exclusive of any applicable taxes
including Value Added Tax (VAT), levies, duties or of similar nature imposed
by the Government / Tax Authority, whether applicable now or in future and
will be charged separately and payable by the Carrier. Wherever not
specifically mentioned, all the charges are payable by the Carrier.
e. The Tariff is subject to revisions and surcharges as imposed by the Authority
or governmental or quasi-governmental authorities or bodies, without
appropriate advance notice and which automatically shall become part of the
Tariff and payable by the Customer, from the date of their formal
implementation (current or retrospective).
