Administrative Decision No. (220) of 2024 On the Schedule of Violations, Fines and Administrative Penalties Related to Law No. (2) of 2012 Concerning the Preservation of the General Appearance, Health and Public Serenity

Article 1 ¶

In application of the provisions of this Decision, the following words and expressions shall
have the meanings assigned thereto, unless the context requires otherwise:
Emirate The Emirate of Abu Dhabi.
Department The Department Municipalities and Transport.
Concerned
Municipality
Abu Dhabi City Municipality, Al Ain City Municipality, Al
Dhafra Region Municipality, or any other municipality that
may be established in the future in the emirate.
Law The above-mentioned Law No. (2) of 2012.
Regulations for
General Appearance
and Public Serenity
The regulations issued under the law to maintain the general
appearance and the public serenity, namely the regulation for
preserving the general appearance, the regulation for maintaining
public places, the regulation for reducing the disturbance
manifestations, the regulation for camping and events, the regulation
for using the satellite dishes, the regulation for abandoned vehicles,
the regulation for preserving the walls and the regulation for
advertising billboards.
Grievances
Committee
One or more committees that is formed in the municipality and is
competent to receive grievances related to the application of the law,
and the regulations and decisions issued thereunder, and decide on the
same in accordance with the applicable legislations.
Public Places Parks, deserts, beaches, roads and the like, irrespective of the
restrictions that may be applied on them.
General Appearance Anything that preserve the cultural, architectural and aesthetic
aspects of Public Places in the Emirate, including grass-covered
spaces, pavements, buildings and their walkways, markets,
fences and public roads. Behavior and attitudes that may in any
way impair this appearance are prohibited.
Disturbance Anything that may cause harm or annoyance to others or
constitutes a trespass on private or public property or safety

which may negatively affect human physical, psychological or
social safety, including but not limited to, individual or group
behavior which would restrict the freedom or sanctity of others
and lead to panic, annoyance or provocation.
Public Serenity The state of tranquillity and quietness in roads, Public Places,
and residential places which ensures total comfort for the public
against any action that causes disturbance or noise in any form.

Article 3 ¶

- The judicial police officer shall be responsible for monitoring and detecting violations in
accordance with the following procedures:
1. Issue the reports of detected violations. For this propose, they have the authority to
require presentation of the necessary documents.
2. Notify the violator of the violation. Also, such notice may be served in an electronic
way.
3. The authorized judicial police officer may offer a settlement to the violator and register
the same in the violation report.
- When the violations are detected, the judicial police officers may do the following:
1. Using the devices and technologies determined by the concerned municipality.
2. Seeking the assistance of the police or any other competent entity, if required.

Article 4 ¶

The Chairman of the Department or his authorised representative may offer the settlement to
the violator according to the following procedures:
1. The settlement shall be offered and registered in the detected violation report using the
form prepared for this purpose and as per the processes adopted by the department.
2. The violator accepting the settlement shall submit his approval on the settlement in
writing or electronically according to the processes adopted by the department.
3. The violator shall remove the effects of the violation during the deadline specified by
the concerned municipality.
4. The violator shall pay 75% of the amount of the fine determined for the violation after
ensuring that all the causes and effects of the violation are removed and paying any
other expenses or fees related to the violation within a period not exceeding sixty days
from the date on which the settlement is offered to the violator.

5. The violation shall be removed after being settled by the violator and paying 75% of
the value of the fine resulting from the violation during the settlement period. The
violation may not be reopened and no grievance shall be filed against it.
6. The settlement shall not remove the violation in case that the violation is repeated.

Article 5 — The concerned municipality may impose any of the following administrative penalties: ¶

1. Serving a notice.
2. Suspending the violating activity and seizing the used tools.
3. Removing the violation at the expense of the violator.
4. Suspending the license or withdrawing it temporarily.

Article 6 — 1. The violator may submit a grievance to the grievances committee the against the ¶

administrative penalty through the channels provided by the concerned municipality, and
using the prepared form, stating the reasons for the grievance and providing the supporting
documents. In all cases, no grievance shall be accepted after the expiration of a week from
the date on which the violator is notified of the administrative penalty.
2. The grievances committee shall review and decide on the grievance, while providing the
grounds for rejection or acceptance within two weeks from the date on which the grievance
is submitted. In all cases, if the grievance is not decided within the aforementioned period,
it will be considered as rejected. Also, the violator shall be notified of the outcome in
accordance with the established procedures.
3. The grievance shall not cease or interrupt the period of settlement, which will remain valid
throughout the period of reviewing and resolving the grievance.

Article 7 ¶

1. In all cases, the violator is required to remove the causes and effects of the violation and
restore the status to its original state within the deadline specified by the concerned
municipality. If the violator does not comply after the deadline has elapsed, the concerned
municipality shall remove such causes and effects at the violator’s expense.
2. If the end of the deadline coincides with a weekend or a public holiday, the deadline will
be extended to the first working day thereafter. In all cases, the violator shall be given a
time limit to correct the situation or to remove the causes and effects of the violation.
3. The concerned municipality may remove the causes and effects of the violation
immediately, without regard to the deadline of removal, if necessary.

Article 8 ¶

1. The principle of gradual application of administrative penalties for violators shall be taken
in consideration. However, more severe administrative penalties may be imposed
immediately when the nature and circumstances of the violation warrant such action.
2. The violation shall be deemed a repeated one if committed within one year from the date
on which the violation is committed for the first time. Also, the penalty shall be increased
in the case of repetition in accordance of the Schedule attached hereto.
3. Each concerned municipality shall prepare a record for violators, including their data,
committed violations, and the type of administrative penalty imposed in violators, its date,
the number of repetitions, and any other data that it deems necessary.
4. The concerned municipality may coordinate and seek the assistance of the competent
government entities to implement the administrative penalties it imposes, if necessary, and
in accordance with applicable legislations.

Article 10 ¶

This decision shall be published in the Official Gazette and shall become effective from the
date of its publication.
