Administrative Decision No. (220) of 2024 On the Schedule of Violations, Fines and Administrative Penalties Related to Law No. (2) of 2012 Concerning the Preservation of the General Appearance, Health and Public Serenity

المادة 1 ¶

بمناسبة تطبيق أحكام هذا القرار، فإن الكلمات والعبارات التالية تحمل المعاني التي تُعين عليها، ما لم يتطلب السياق خلاف ذلك:
الإمارة الإمارة أبوظبي.
الإدارة الإدارة للمدن والنقل.
المُعنى به
المدينة
مدينة أبوظبي، مدينة العين، مدينة منطقة الذفرا، أو أي مدينة أخرى قد تُنشأ مستقبلاً في الإمارة.
القانون القانون المذكور أعلاه رقم (2) لسنة 2012.
الأنظمة الخاصة بالهيئة العامة والهدوء العام
الأنظمة الصادرة بموجب القانون للحفاظ على الهيئة العامة والهدوء العام، أي نظام الحفاظ على الهيئة العامة، ونظام الحفاظ على الأماكن العامة، ونظام تقليل التأثيرات المُزعجة، ونظام المخيمات والمناسبات، ونظام استخدام الأطباق الفضية، ونظام المركبات المهجورة، ونظام الحفاظ على الجدران، ونظام الإعلانات الإعلانية.
الشكاوى
الجهاز
جهاز واحد أو أكثر يُشكل في المدينة ويختص بقبول الشكاوى المتعلقة بتطبيق القانون، والنظام والقرارات الصادرة عنه، واتخاذ قرارات بشأنها وفقاً للتشريعات المطبقة.
الأماكن العامة الحدائق، الصحراء، الشواطئ، الطرق وغيرها، بغض النظر عن أي قيود قد تُطبق عليها.
الهيئة العامة أي شيء يحافظ على الجوانب الثقافية والمعمارية والأدبية للأماكن العامة في الإمارة، بما في ذلك المساحات المغطاة بالعشب، والطريقات، والمباني ومساراتها، والأسواق، والأسوار، والطرق العامة. ويُحظر أي سلوك أو تصرف قد يؤثر بأي طريقة على هذه الهيئة العامة.
التأثير أي شيء قد يسبب ضرراً أو إزعاجاً لأي شخص أو يُعتبر انتهاكاً لملكية خاصة أو عامة أو السلامة.

التي قد تؤثر سلبًا على السلامة الجسدية، النفسية أو الاجتماعية للإنسان، بما في ذلك ولكن لا تقتصر على السلوك الفردي أو الجماعي الذي قد يعيق حريات أو كرامة الآخرين ويؤدي إلى الذعر أو الإزعاج أو التحريض.
الهدوء العام حالة الهدوء والسكينة في الطرق، والأماكن العامة، والأماكن السكنية التي تضمن الراحة الكاملة للجمهور ضد أي فعل يؤدي إلى إخلال أو ضوضاء بأي شكل.

المادة 3 ¶

يتحمل الضابط القضائي مسؤولية مراقبة ومتابعة انتهاكات التزامات الأفراد وفقاً للإجراءات التالية:
1. إعداد تقارير عن الانتهاكات المكتشفة. ولها الحق في طلب تقديم الوثائق اللازمة لهذا الغرض.
2. إبلاغ المخالف بتفاصيل الانتهاك. ويمكن إرسال هذا الإبلاغ إلكترونياً.
3. يمكن للضابط القضائي المُخول أن يتفاوض مع المخالف ويُسجل التفاوض في تقرير الانتهاك.
- وفي حالة اكتشاف الانتهاكات، يمكن للضباط القضائيين القيام بما يلي:
1. استخدام الأجهزة والتكنولوجيا التي يحددها الجهة المعنية.
2. طلب مساعدة الشرطة أو أي جهة أخرى مؤهلة إذا لزم الأمر.

المادة 4 ¶

يُمكن للرئيس أو ممثله المُفوض في القسم تقديم التسوية للخالِد وفقًا للإجراءات التالية:
1. تُقدَّم التسوية وتُسجَّل في تقرير المخالفة المكتشفة باستخدام النموذج المعد لهذا الغرض ووفقًا للإجراءات التي تتبناها الإدارة.
2. يُقدِّم الخالِد موافقته على التسوية كتابةً أو إلكترونيًا وفقًا للإجراءات التي تتبناها الإدارة.
3. يجب على الخالِد إزالة آثار المخالفة خلال المدة المحددة من قبل البلدية المختصة.
4. يجب على الخالِد دفع 75% من قيمة الغرامة المقررة للمخالفة بعد التأكد من إزالة جميع أسباب وآثار المخالفة ودفع أي تكاليف أو رسوم أخرى مرتبطة بالمخالفة خلال فترة لا تتجاوز ستين يومًا من تاريخ تقديم التسوية للخالِد.

5. تُزال المخالفة بعد إزالةها من قبل الخالِد ودفع 75% من قيمة الغرامة الناتجة عن المخالفة خلال فترة التسوية. لا يمكن إعادة فتح المخالفة وليست هناك أي شكاوى تُرفع بشأنها.
6. لا تُزال المخالفة بالتسوية في حالة تكرارها.

المادة 5 — الإدارة المحلية المعنية يمكنها فرض أي من العقوبات الإدارية التالية: ¶

1. إصدار إشعار.
2. إيقاف النشاط المخالف وحجز الأدوات المستخدمة.
3. إزالة المخالفة على نفقته.
4. إيقاف الترخيص أو سحبه مؤقتًا.

المادة 6 — 1. يمكن للمخالف تقديم شكوى إلى لجنة الشكاوى ضد ¶

يُقدَّم التظلم عبر القنوات التي تُقدِّمها البلدية المعنية، باستخدام النموذج المعدّ، وبيان أسباب التظلم وتقديم الوثائق الداعمة. وفي جميع الأحوال، لا يُقبل أي تظلم بعد انتهاء أسبوع من تاريخ إبلاغ المخالف بعقوبة إدارية.
2. يُنظر التظلم ويُصدر قراره لجنة التظلمات، مع إيضاح أسباب القبول أو الرفض خلال أسبوعين من تاريخ تقديم التظلم. وفي جميع الأحوال، إذا لم يتم إصدار قرار بشأن التظلم خلال الفترة المذكورة أعلاه، فإنه يُعتبر مرفوضًا. كما يُبلغ المخالف من نتيجة التظلم وفقًا للإجراءات المقررة.
3. لا يُوقف أو يُقطع فترة التسوية التظلم، والذي يبقى ساري المفعول خلال فترة النظر والبت فيه.

المادة 7 ¶

1. في جميع الحالات، يُلزم المخالف بحذف أسباب ونتائج المخالفة وردّ الحالة إلى حالتها الأصلية ضمن المدة المحددة من قبل البلدية المعنية. وإذا لم يُطَّق المخالف هذه المدة، تُحذف أسباب ونتائج المخالفة البلدية المعنية على نفقته.
2. إذا تزامن نهاية المدة مع عطلة نهاية الأسبوع أو عطلة رسمية، تُمدد المدة إلى أول يوم عمل تالي. وفي جميع الحالات، يُمنح المخالف فترة زمنية لتصحيح الوضع أو لحذف أسباب ونتائج المخالفة.
3. يمكن للبلدية المعنية أن تُحذف أسباب ونتائج المخالفة فورًا، دون مراعاة مدة الحذف، إذا لزم الأمر.

المادة 8 ¶

1. يُراعى مبدأ تطبيق العقوبات الإدارية بشكل تدريجي على المخالفين. ومع ذلك، يمكن فرض عقوبات إدارية أكثر صرامة فورًا إذا كانت طبيعة المخالفة وظروفها تستدعي ذلك.
2. تُعتبر المخالفة مُكررة إذا تكررت خلال سنة من تاريخ ارتكاب المخالفة لأول مرة. كما تُزيد العقوبة في حالة التكرار وفقًا للجدول المرفق بهذا القرار.
3. يجب أن تقوم كل بلدية مختصة بتسجيل المخالفين، بما في ذلك بيان بيان بيانات المخالفين، ونوع المخالفات التي ارتكبها، والعقاب الإداري الذي تم فرضه عليه، وتاريخه، وعدد التكرارات، وأي بيانات أخرى تراها مناسبة.
4. يمكن للبلدية المختصة التنسيق وطلب مساعدة الجهات الحكومية المختصة لتنفيذ العقوبات الإدارية التي تفرضها، إذا لزم الأمر، ووفقًا للقوانين التطبيقية.

المادة 10 ¶

This decision shall be published in the Official Gazette and shall become effective from the
date of its publication.
